Earlier this week, Stris & Maher prevailed before the Fifth Circuit in Humana Health Plan Inc. v. Nguyen, No. 14-20358. At issue was whether a third-party administrator possessed the fiduciary authority to investigate and prosecute reimbursement claims under ERISA. The court of appeals concluded 2-1 that it did not, reversing the district court below.
