In a June 9, 2025 article entitled “Businesses Warn Fed. Circ. Against Pausing Block On Tariffs,” Law360 covered the amicus brief filed by Matthew Seligman in the Federal Circuit supporting the U.S. Court of International Trade’s order striking down President Trump’s tarriffs:
“Thousands of businesses will suffer ‘irreparable harm’ if the Federal Circuit halts the U.S. Court of International Trade’s order that struck down President Donald Trump’s global tariffs, a wine importer told the appellate court, urging against a long-term pause.

A group of former government officials — including federal judges, members of Congress, and senior U.S. Department of Justice and White House appointees — also backed the states and small business in an amicus brief filed Monday. According to the former officials, the IEEPA does not authorize the president to impose the tariffs because trade imbalances are not an ‘unusual and extraordinary threat’ under the statute.
