Radha Pathak secures appellate victory in the Fifth Circuit

Congratulations to Radha Pathak on another appellate victory in Parrott v. International Bancshares Corp. The Fifth Circuit’s published decision adds yet another win to an extraordinary run of appellate advocacy. With this result, Radha has now secured victories in five of her seven recent appeals.
 
What makes this one especially meaningful: the court confirmed that while an ERISA retirement plan can require arbitration of certain fiduciary-duty disputes, it can’t do so in a way that dilutes ERISA’s core protections. In plain terms, the decision preserves participants’ ability to seek plan-wide relief and the full remedies ERISA provides, even in an arbitration setting.
