Stris & Maher Obtains Certiorari in Important Insurance Remedies Case
The Supreme Court granted certiorari in Montanile v. Board of Trustees of the National Elevator Industry Health Benefit Plan, No. 14-723 on March 30, 2015. The case, which involves the scope of rights ERISA plans have to recoup money from beneficiaries, is the sixth ERISA case since 2006 in which Stris & Maher attorneys have appeared before the Supreme Court on the merits. Peter Stris will be arguing the case for Mr. Montanile, and Neal Katyal, the former acting Solicitor General of the Obama administration, will be arguing the case for the plan.
